It's in the same vein as fan fiction writing, which despite complaints, isn't going anywhere. Even if they used an established character it still wouldn't work because it wouldn't be canon. Let alone work within the actual confines of what's been written about the world by the writer, since canonically it doesn't glorify smut or have anything explicit.
